1. Acceptance of Terms
By accessing or using LucidSky ("the Service"), including our website at lucidsky.app and any associated mobile applications, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
LucidSky is a weather information application that displays forecast data sourced from the National Weather Service (NWS), alternative weather models via Open-Meteo, air quality data from the EPA AirNow program, and other publicly available data sources. The Service adds computed uncertainty ranges, weather safety insights, and AI-generated forecast interpretations on top of this source data.
LucidSky offers both free and premium tiers. Free users can access weather forecasts, hourly conditions, radar, weather alerts, current air quality data, and astronomy data. LucidSky Pro subscribers additionally gain access to minute-by-minute precipitation nowcasts, advanced weather models, multi-model comparison, AI forecast discussions, NWS forecaster briefings and local product summaries (fire weather, recreational, avalanche, marine, and regional discussions), extended 14-day forecasts, forecasted air quality, seasonal outlooks, marine and ocean conditions, river discharge monitoring, daily weather digest emails, and date trackers (forecast monitoring for future dates with daily email notifications).
3. License Grant
Subject to your compliance with these Terms, LucidSky grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to modify, distribute, sell, or create derivative works based on the Service or any content provided through it.
4. Prohibited Activities
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service
- Use automated scripts, bots, scrapers, or other automated means to access the Service or extract data in a manner that places unreasonable load on our infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Circumvent, disable, or otherwise interfere with any rate-limiting, security, or access-control features of the Service
- Resell, redistribute, or commercially exploit any content or data obtained from the Service without prior written permission
We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you are engaging in prohibited activities.
5. Intellectual Property
The Service, including its design, user interface, graphics, AI-generated content, compiled data presentations, branding, and all software code, is the property of LucidSky and is protected by copyright, trademark, and other intellectual property laws.
Underlying weather data sourced from the National Weather Service is in the public domain. Data from other third-party providers is subject to those providers' respective terms. However, LucidSky's original presentation, arrangement, computed derivatives (such as uncertainty ranges and safety insights), and AI-generated interpretations of that data are proprietary.
You may not reproduce, modify, reverse engineer, decompile, disassemble, or create derivative works based on the Service or any of its proprietary content without our prior written consent.
6. Informational Purposes Only — Not Safety Guidance
All content provided by LucidSky, including but not limited to weather safety insight cards and AI-generated forecast discussions, is for general informational purposes only.
LucidSky is not a substitute for:
- Official weather warnings and alerts issued by the National Weather Service
- Guidance from local emergency management authorities
- Your own personal judgment regarding outdoor safety
- Professional advice from meteorologists or safety experts
You should always monitor official NWS alerts and warnings, check local advisories, and exercise personal judgment before making decisions about outdoor activities, travel, or safety based on weather conditions.
7. No Guarantee of Accuracy
Weather forecasts are inherently uncertain. LucidSky sources data from third-party providers (primarily the National Weather Service and EPA AirNow) and cannot guarantee the accuracy, completeness, or timeliness of any data displayed.
Specifically:
- Forecast data may be delayed, incomplete, or incorrect due to upstream data source issues.
- Uncertainty ranges are computed estimates based on forecast lead time, model agreement, and ensemble statistics. They are not official NWS products.
- Weather safety insights are algorithmically generated based on weather conditions. They are estimates, not guarantees of safe or unsafe conditions.
- AI-generated content (forecast discussions, briefing summaries) are machine interpretations of NWS data and may contain errors or misinterpretations. Always refer to the original NWS source for authoritative information.
8. AI-Powered Features & Third-Party Data Processing
LucidSky uses Anthropic's Claude API, a third-party artificial intelligence service, to generate plain-English forecast summaries, briefing interpretations, and forecast comparison narratives.
When AI features are used, the following data is sent from our servers to Anthropic for processing:
- NWS forecast text and weather product data (publicly available government data)
- Your general location context: city name, state or region, and approximate coordinates (~1 km precision)
- Temperature and precipitation data relevant to the forecast
- For non-US forecast discussions: multi-model ensemble data and model-agreement metrics (temperature spread, precipitation probability spread, and a confidence score) synthesized from publicly available weather models
No personal information (email, device identifiers, payment details, or precise GPS coordinates) is sent to Anthropic. Data sent via the Anthropic API is not used to train AI models and is retained by Anthropic for up to 30 days for trust and safety purposes. For complete details, see our Privacy Policy.
The app does not include free-text input fields that transmit user-authored content to the AI service. All AI inputs are system-generated from weather data and structured user preferences (e.g., sky condition category and temperature range selected from predefined options).
By using LucidSky, you consent to this data processing. AI-generated content is labeled in the app and is provided for informational purposes only.
9. Assumption of Risk
Outdoor activities carry inherent risks regardless of weather conditions. By using LucidSky, you acknowledge that:
- Weather conditions can change rapidly and without warning
- You assume full responsibility for your decision to engage in any outdoor activity
- You will independently verify conditions before engaging in activities where weather poses safety risks
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
LucidSky does not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results or data obtained through the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your specific requirements
You use the Service at your sole risk. No advice or information, whether oral or written, obtained from LucidSky shall create any warranty not expressly stated in these Terms.
11. Limitation of Liability
To the maximum extent permitted by applicable law, LucidSky and its creators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to personal injury, property damage, or loss of any kind — arising from or related to:
- Your use of or reliance on information provided by the Service
- Any inaccuracy, delay, or omission in the data or content
- Decisions you make based on content provided by the Service
- Your inability to access the Service at any time
- Any unauthorized access to or alteration of your data
- Any third-party conduct or content on the Service
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless LucidSky, its creators, officers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your use of or access to the Service
- Your violation of these Terms of Service
- Your violation of any applicable laws or regulations
- Your violation of any third-party rights
13. Data Sources and Attribution
LucidSky uses the following public data sources:
- National Weather Service (NWS) — forecast data, current conditions, alerts, and area forecast discussions. NWS data is in the public domain.
- Open-Meteo — alternative weather model data (ECMWF, GFS, HRRR, ICON, and others), air quality forecasts, seasonal outlooks, marine conditions, flood monitoring, and climate normals.
- EPA AirNow — current air quality index observations.
- Apple WeatherKit — minute-by-minute precipitation nowcasts.
- Iowa Environmental Mesonet — NEXRAD radar imagery tiles.
- NOAA MRMS (Multi-Radar Multi-Sensor)— high-resolution composite radar data processed from NOAA's national radar network.
- Rainbow.ai — high-resolution precipitation radar imagery.
- U.S. Naval Observatory (USNO) — sunrise, sunset, moonrise, moonset, lunar phase, and planetary data.
- OpenStreetMap Nominatim — location search and geocoding.
- Environment and Climate Change Canada (ECCC): weather alerts for Canadian locations.
- Zippopotam.us: ZIP code lookup and coordinate resolution.
LucidSky is not affiliated with, endorsed by, or sponsored by any of these organizations.
14. Subscriptions and Billing
LucidSky Pro is available as an auto-renewable subscription. Subscription details, including pricing and trial offers, are displayed at the time of purchase.
- Free trial: New subscribers may be eligible for a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the displayed price.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
- Cancellation:You may cancel your subscription at any time through the App Store (Settings > Apple ID > Subscriptions). After cancellation, you retain access to premium features until the end of your current billing period.
- Refunds: Refund requests are handled by Apple in accordance with the App Store refund policy.
15. Usage Limits
To ensure fair usage and manage infrastructure costs, the following limits apply:
- Rate limiting: Requests are subject to IP-based rate limits to prevent abuse and protect service availability.
- AI features: AI-generated content is cached at two layers: roughly 6 hours at the request-handler layer and up to 7 days in our database so identical forecasts do not re-invoke the AI. You may occasionally see summaries based on a slightly earlier forecast.
- Date trackers (Pro): Up to 3 active date trackers per account. Trackers may be created for dates up to 14 days in advance. A daily forecast snapshot email is sent for each active tracker.
These limits are subject to change. We will make reasonable efforts to notify users of significant changes.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict-of-law provisions.
Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New York, New York. You consent to the personal jurisdiction of such courts and waive any objection to the convenience of such forum.
17. Changes to These Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.
